Post360 Terms of Use

1. Acceptance of Terms

These Terms of Use govern your access to and use of Post360, a social media scheduling and content-planning platform operated by DEV Technologies LLC. By accessing or using Post360, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use Post360.

2. The Post360 Service

Post360 is a social media scheduling and content-planning platform that allows you to create, schedule, and manage content across connected social media accounts. Post360 is a tool that acts on your instructions; it does not independently create, publish, or control content on your connected accounts without your direction.

3. Account Registration and Responsibility

You must register an account to use certain features of Post360. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when registering and to keep your account information current. You must be at least the age of majority in your jurisdiction to use Post360.

4. Permitted Use

You agree to use Post360 only for lawful purposes. You may not:

• Use Post360 in a way that violates applicable law or regulation
• Post or transmit content that is unlawful, defamatory, infringing, or otherwise objectionable
• Attempt to gain unauthorized access to Post360 or its systems
• Use automated tools to scrape or extract data from Post360
• Interfere with or disrupt the service or servers used to provide Post360
• Misrepresent your identity or affiliation

5. Your Content and Responsibility

You are responsible for all content you create, upload, schedule, or publish through Post360. You are responsible for ensuring that your content complies with the terms of service, content policies, and community guidelines of each connected social media platform to which you publish. Post360 is not responsible for reviewing or approving your content and is not liable for the consequences of publishing content that violates a connected platform's rules.

6. Authorization to Process Connected-Account Instructions

When you connect a social media account and direct Post360 to schedule or publish content, you authorize Post360 to use the connected account's authorization tokens to carry out your instructions, including posting content, retrieving post status, and managing scheduled posts on your behalf. You may revoke this authorization at any time by disconnecting the account in Post360 or through the connected platform's settings.

7. Third-Party Platform Availability and Restrictions

Post360 integrates with third-party social media platforms. The availability, features, and functionality of these platforms may change at any time and are outside Post360's control. Platform API access, rate limits, content policies, and publishing requirements may affect what Post360 can do on a given platform. Post360 is not responsible for a platform's decision to reject, remove, or restrict your content or account.

8. Subscriptions and Billing

Post360 offers paid subscription plans. Paid plans are billed through Stripe. By selecting a paid plan, you agree to pay the applicable fees. We reserve the right to change pricing with reasonable notice. Failure to pay may result in suspension or termination of your account.

9. Billing, Cancellation, and Refunds

Post360 paid plans are billed through Stripe. You may manage an eligible paid subscription through the Post360 billing area and Stripe's secure customer portal after a paid subscription is created. A voluntary cancellation takes effect at the end of the current paid billing period. You retain paid access through that period, and the subscription then ends. Subscription fees are non-refundable after a billing period begins, except where required by applicable law.

10. Intellectual Property

You retain ownership of all content you create and publish through Post360. By using Post360, you grant Post360 a limited license to store, process, and transmit your content solely for the purpose of providing the service to you. The Post360 name, logo, platform design, and related materials are the intellectual property of DEV Technologies LLC and may not be copied or used without permission.

11. Service Availability and Changes

Post360 is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue features of Post360 at any time. We do not guarantee uninterrupted or error-free service.

12. Suspension or Termination

We may suspend or terminate your access to Post360 if we believe you have violated these Terms or engaged in misuse. Upon termination, your right to use Post360 ceases. Provisions of these Terms that by their nature should survive termination shall remain in effect.

13. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law, Post360 and DEV Technologies LLC are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Post360. Post360 is not responsible for the actions, policies, or content policies of connected social media platforms.

14. Changes to These Terms

We may revise these Terms at any time. We will provide notice of material changes by posting a prominent notice within Post360 or by other reasonable means. Your continued use of Post360 after changes take effect constitutes your acceptance of the revised Terms.
